Drug driving or driving under the influence of an illicit drug is as dangerous as drink driving and the law calls for the driver to submit to a random drug test when required. 

An example we are involved in is of a young gentleman who had taken an illicit substance (a pill which turned out to be methamphetamines) approximately 5 or 6 hours prior to being stopped by the Police.  He was stopped for a random breath test which proved negative.  At the time he was then subject to an oral fluid test by way of a swab.  This proved positive and then he was asked for a further sample for analysis. 

The analysis came back to the Police by way of sealed security number and at the time he was charged with driving under the influence of a drug pursuant to the Roads Traffic (Safety and Management) Act 1999 Section 11(b). 

Fortunately enough for our client that Act falls to a different disqualifications.  The penalty given in this gentleman case was similar to low range drink driving and he was found guilty of that offence.  It is interesting to note that it is important that people who have got illicit drugs in their system that they do not drive a motor vehicle.  Each and every individual persons make up will take a certain period of time to remove the illicit substances from the body.  It is clear that the drugs taken take some considerable time and will affect the ability of a person to drive a motor vehicle and therefore the reason for the law in respect of driving under the influence of an illicit drug.  It is important that people have their rights properly protected if they are so caught.

Example of a Good Rssult in a Drug Driving case

We acted for a gentleman who had been to a social function and was caught mid range of drink driving.  His only excuse was that he had a number of light beers and thought that he was still under the influence.  His need for his licence was dramatic in that he lived in the Eastern Suburbs and worked approximately 1 hour away by car.  It was almost impossible for him to get to and from work without a driver’s licence.  At first instance before the Local Court the client lost his licence for a minimum mandatory period of six months.  The Court was sympathetic to our client’s plight but said there was no real reason why he should keep his licence and he should learn a nice lesson. 

We were unsatisfied with this and therefore lodged an appeal.  The District Court in overturning the original order said as follows “His need for his licence was dramatic.  That circumstances of the offence were minor and accordingly applied Section 10(1)(a) of the Crimes Sentencing Procedure Act and dismissed the matter after being found guilty with no bond and no conditions.”  A great result for a client that was very happy.
